              CEMETERY MAINTENANCE DISTRICT
              AMENDMENTS
              1996 GENERAL SESSION
              STATE OF UTAH

          AN ACT RELATING TO SPECIAL DISTRICTS; PROVIDING THAT ALL VACANCIES ON
          CEMETERY MAINTENANCE BOARD BE FILLED BY APPOINTMENT; REPEALING
          PROVISIONS RELATING TO DUTIES OF TREASURER AND DRAFTS AND
          WARRANTS PROCEDURE; AND MAKING TECHNICAL CORRECTIONS.
          This act affects sections of Utah Code Annotated 1953 as follows:
          AMENDS:
          17A-2-209 , as last amended by Chapter 200, Laws of Utah 1995
          17A-2-210 , as last amended by Chapter 273, Laws of Utah 1991
          REPEALS:
          17A-2-224 , as renumbered and amended by Chapter 186, Laws of Utah 1990
          17A-2-225 , as renumbered and amended by Chapter 186, Laws of Utah 1990
          Be it enacted by the Legislature of the state of Utah:
              Section 1. Section 17A-2-209 is amended to read:
              17A-2-209. Terms of office.
              The first members of the [special district] cemetery maintenance board appointed by the
          county legislative body shall serve terms of two and four years respectively until the next board
          members are [elected or] appointed.
              Section 2. Section 17A-2-210 is amended to read:
              17A-2-210. Appointments to fill vacancies -- Terms of office -- Oath.
              (1) [The cemetery maintenance district shall hold an election to fill the] All vacancies on
          the cemetery maintenance board shall be filled by the county legislative body by following the
          procedures and requirements of [Title 17A, Chapter 1, Part 3] Section 17A-1-303 .
              (2) (a) The [commissioners] board members shall:
              (i) assume their duties at noon on the first Monday in January;
              (ii) serve without compensation, but be reimbursed for their actual and necessary expenses;
          and
              (iii) take and subscribe to the official oath.
              (b) The subscribed oath shall be filed with the county legislative body.
              Section 3. Repealer.
              This act repeals:
              Section 17A-2-224 , Duties of treasurer.
              Section 17A-2-225 , Drafts and warrants to be countersigned by secretary.
