9:00 a.m.    1.    Call to Order and Committee Business - Sen. Craig L. Taylor, Chair

            - Approval of Minutes of the April 17, 1996 Meeting    

        2.    Indigent Defense Costs

             Utah has adopted a county-based indigent criminal defense system, under which each county pays for the legal representation of indigents at trial and on appeal. This system lends itself to potentially crippling fiscal obligations, particularly in high-profile capital cases that occur in rural counties. The committee will discuss the nature of this issue as it relates to indigency standards, a proposed pooling of funds between counties and the state, and appellate cases.

10:40 a.m.    3.    Uniform Unclaimed Property Act (1995) - Draft Legislation

            The committee will review draft legislation which incorporates proposed uniform law addressing interstate problems associated with unclaimed property administration. The proposed uniform law changes the abandonment period for gift certificates and proceeds for insurance policies from five to three years. It also limits agreements of fee finders with unclaimed property owners.

11:00 a.m.    4.    Child Support Guidelines

            The committee will initiate discussion on the application of the 1994 adjustments to the Child Support Guidelines. Committee members will receive copies of written comments from interested parties, which are to be submitted to the Office of Legislative Research and General Counsel by May 13, 1996. Although a public hearing will be held later this Fall, this discussion will not be open to public comment. However, for

clarification, the committee may call on interested parties to represent various positions or respond to questions regarding written materials received by the May 13 deadline. Written materials and suggestions will be submitted to experts and judges who have jurisdiction over this area of the law for review and follow-up responses later this Fall.
