R657-32. Wildlife License, Permit or Certificate of Registration Refund.

R657-32-1 Purpose and Authority.

Under Section 23-19-38 this rule provides the conditions and procedures for obtaining a refund for a wildlife license, permit, or certificate of registration.

R657-32-2 Definitions.

Terms used in this rule are defined in Section 23-13-2.

R657-32-3 Conditions.

(1) The division may refund the amount of a license, permit, or certificate of registration if:

(a) the division or Wildlife Board discontinue the activity for which the license, certificate of registration, or permit was obtained; or

(b) the person to whom the license, permit, or certificate of registration is issued dies prior to that person's being able to participate in the activity for which the license, certificate of registration, or permit was obtained.

(2) A person is deemed to have not been able to participate in the activity for which the license, permit, or certificate of registration was issued if:

(a) that person's death occurred prior to the opening day of any season for which the license, permit, or certificate of registration would have allowed that person to participate; or

(b) the director determines that the decedent did not have an opportunity to participate in the activity for which the decedent intended to use the license, permit, or certificate of registration.

R657-32-4 Refund Procedures.

(1) A legal heir may receive the refund for a license, permit, or certificate of registration upon providing the division with:

(a) proper identification indicating relationship with the decedent;

(b) a certified copy of the decedent's death certificate; and

(c) the license, permit, tag, or certificate of registration for which a refund is requested.

(2) An application for a refund may be obtained from any division office.
